Q: Do you have to have proof to accuse someone of sexual harassment?
I recently got fired from my job for no good reason.. I simply questioned my bosses SIGNIFICANT cut of my predetermined commission amount on a sale in progress TWICE in TWO DAYS! Then he sends a junior employee to fire me because he’s a coward and now I’m screwed.. Unemployed with a freaking BMW Z4 sitting in the driveway.. Am I cool or what? Sorry, I’m still mad and in need of a good venting.
So this man is a freaking creep.. He used to text me the most nasty things but never would say them in real life because, like I said, he’s a coward. I deleted these texts because I didn’t want my boyfriend to see them but can I still try to get him for sexual harassment? The other 2 girls have to deal with the same nasty texts and I’m hoping they’d vouch, although I’m not sure if they both would if they had to fear for their job. Even the guys are aware of the way he treats women though. So what do you think?
Because he’s a horrible person and deserves every bad thing that comes his way. He’s the owner of a multi-million dollar company and he’s just greedy and deceitful.. God.. There aren’t words to describe him. Beyond evil.
He is the owner and president of the company. I was the executive assistant and in charge of sales so I worked directly for him. No one to go over unfortunately. I’m not wanting to sue for revenge or for being broke, but thanks for the support, LOL. Ever since this has been going on I’ve wanted to do something but unfortunately he’s very manipulative and he knows how to work people, in short he’s a successful business man..
A: Good luck on your new job search and congratulations on getting away from a negative job situation! When you walk in the door on starting a job, employers have you pegged: they know most employees will never complain about anything, only a few will complain verbally or in writing, and that leaves only a small per cent that will exercise their right to sue over unlawful conditions of sexual harassment. Wouldn’t it be nice if your rights in the workplace could be attained without any cost involved? But there will be a cost in time, money, and emotional stress to fight for your rights. Having years of experience in employment litigation [as a non-attorney], I am convinced that 99% of employers will retaliate against you if you complain, and many times you may have more of a case for retaliation because you complained and less of a case for the actual sexual harassment. First, try to recognize that you have been emotionally hurt and you rightfully want to exact some type of restitution of your rights or rightfully seek damages. Life is short: is it worth it to fight or to move on to a better situation? That is your choice. Second, anyone can make an accusation; but you don’t want to be liable for a false accusation bearing no proof. But your proof could be as little as a written declaration giving dates and times and witnesses. [Next time save those emails because they could be like money in the bank.] I would recommend you go to the law library and read up on sexual harassment cases and what evidence might be needed. Read your states labor law and sexual harassment laws. Read the excellent book “Every Employees Guide to the Law.” For examples of some of the proof needed and some of the agencies to contact, and what you may face in an uphill battle, see the related and excellent website www.16lunchtime42.com. While it seems that many people win big money in sexual harassment cases, it is really a small percentage of the many people who bring charges and lose. Time and money. You can’t play Monopoly unless you have [play] money! Perhaps writing a letter to your ex boss letting him know you plan to file a complaint, or perhaps contacting the Department of Fair Housing and Employment, will bring you some satisfaction or even a settlement offer to keep you from mounting a lawsuit. Even if you file a lawsuit and have loads of evidence, there is no guarantee you will win and you may be stuck with a BIG attorney bill! So if you must spend hours and hours on this, first get some evidence and facts down in writing. I don’t suppose you were on the job very long but if it is less than a year that is not in your favor. Being a princess in shining armor may be admirable but is this the best way to do it?
